1. Acceptance of Terms

By accessing or using Worldmart Overseas's website and trade services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use our services.

Important: These terms include provisions limiting our liability and requiring arbitration of disputes related to international trade.

2. Services Overview

Worldmart Overseas provides comprehensive global trade solutions including:

Export and import of agricultural products and spices
International sourcing of hardware and construction materials
End-to-end logistics and supply chain management
Customs clearance and trade compliance services
Market research and trade consultation

Note: Specific terms for each service will be outlined in separate trade agreements and contracts.

3. User Responsibilities

When using our trade services, you agree to:

Provide accurate and complete business documentation
Comply with all applicable international trade laws and regulations
Obtain necessary import/export licenses and permits
Ensure product compliance with destination country regulations
Maintain confidentiality of trade terms and pricing
Not engage in fraudulent or prohibited trade activities

4. Orders and Payments

Order Process

International trade orders are subject to:

Product availability confirmation
Export/import compliance verification
Final approval by Worldmart Overseas

Pricing

All prices are:

Subject to change without notice
Quoted in USD unless specified otherwise
Exclusive of duties, taxes, and customs fees unless stated

Payment Terms

Standard international trade payment terms:

30% advance payment with purchase order
60% payment before shipment
10% balance payment after successful delivery

Alternative payment terms (LC, DA, DP) may be available for established trade partners.

5. Shipping and Delivery

Shipping Terms

All shipments are governed by Incoterms® 2020 as specified in the contract:

FOB - Free On Board (port of shipment)
CIF - Cost, Insurance and Freight (port of destination)
EXW - Ex Works (seller's premises)

Delivery Timeline

Estimated delivery times:

Air freight: 3-7 business days (after dispatch)
Sea freight: 15-45 days (depending on destination)
Land transport: 5-10 days (for neighboring countries)

Important: Delivery times are estimates only. Customs delays, weather conditions, and other factors may affect actual delivery times.

6. Returns and Claims

Due to the nature of international trade:

Claims for damaged goods must be filed within 7 days of receipt
Returns require prior authorization
Buyer bears return shipping and customs costs
Refunds processed within 30 days of return acceptance

Non-Returnable Items: Perishable goods, custom-made products, and items with special import restrictions cannot be returned.

7. Intellectual Property

All trade-related intellectual property is protected:

Product designs and specifications remain the property of their respective owners
Worldmart Overseas trademarks may not be used without permission
Trade secrets and pricing information must remain confidential

8. Limitation of Liability

Worldmart Overseas shall not be liable for:

Consequential damages from delays or non-delivery
Losses due to force majeure events (war, natural disasters, etc.)
Customs seizures or import restrictions
Third-party carrier actions or failures
Amounts exceeding the contract value

9. Dispute Resolution

Any trade disputes shall be resolved through:

Good faith negotiation between parties (30 days)
Mediation at the Gujarat Chamber of Commerce
Binding arbitration under Indian Arbitration Act

Court jurisdiction is limited to enforcement of arbitration awards or injunctive relief.

10. Governing Law

These terms shall be governed by Indian law. The courts in Morbi, Gujarat shall have exclusive jurisdiction over any disputes.
